This story originally appeared in the Oregon Capital Chronicle. Judges in Oregon and Washington on Tuesday blocked supermarket giants Kroger and Albertsons from merging, throwing into question the future of the largest proposed grocery merger in U.

The Washington ruling marks the second major blow to Kroger and Albertsons’ plan to combine, coming shortly after Judge Adrienne Nelson of the U.S. District Court in Portland, Oregon, issued her ruling granting a preliminary injunction in favor of the Federal Trade Commission.

Albertsons is suing Kroger for breach of contract and accusing it of failing to exercise its “best efforts” to get regulatory approval for the merger.
